Can I Get My Will Checked?

Can I get my Will checked

Yes, you can get your Will checked. In fact, it is highly recommended that you do. After you have written your Will or had some else write your Will for you, it is a very sensible idea to get your Will checked by a professional to make sure that everything is all in order. But you need to be careful about who you give your Will to get it checked.

Why getting your Will checked is a good idea

Getting your Will checked is recommended. Seeing as you’ve spent a long time thinking about how you want your assets distributed; we feel its essential. However, a lot of wills are found to be invalid once people have died because they didn’t get them checked.

If you have paid to get a solicitor to write your Will, then they should have already checked your Will. But if you have a copy, it may be worth getting it checked to make sure no mistakes have been made; especially if this is the first time that you’ve used the solicitor.

Where to get your Will checked

There are a number of different places that you can get your Will checked, but at WillFinda we not only check your Will. But we also will safely and securely store your Will once we are sure that it is valid.

In order to check your Will we make sure that it meets the following criteria:

  • It was made by someone who is aged 18 or older.
  • Made completely voluntarily without being pressured by anyone else to write the Will; or pressured into leaving certain things to individuals.
The Will must have been made by someone who is of sound mind. That is, they understand and are aware of what writing and signing the Will means. Knowing what assets they have and can identify the people who are going to inherit in writing.
  • Signed by the Will holder in the presence of two independent witnesses.
  • Signed by two independent witnesses in the presence of the Will holder. The witness cannot be beneficiaries of the Will, nor can they be the spouse or civil partner of a beneficiary.

It should also be dated when it is signed. Though it is not a legal requirement to have a date when the Will was signed, it is recommended as it will help identify any attempts at forgery or if an older version of the Will is being acted upon.
